The state now requires the tax-increment disclosure Riverton never published

Riverton levies no city property tax and points to Mountain View Village as proof its development deals work. A state law now makes the city publish the arithmetic behind that claim.

Riverton's case for its economic development deals deserves stating at full strength. The city levies a property tax rate of 0.000000 per cent and says fees exist only to pay for the actual cost of services 6. It was the first Utah city to abolish the standard business licensing fee, in 2018, and it tells businesses exactly that 7. Economic development is the third of its four strategic priorities, including enhancing the Town Center 8. The return it claims is sales tax, and the South Valley Chamber — the city's official chamber — told the council on May 5 that there had been 15 ribbon cuttings in Riverton in the past year 5. The budget treats the tax increment the redevelopment agency collects as revenue; it is revenue that leaves again almost to the dollar 1.

The record complicates that case in three ways, none of them an accusation. First, the price is paid by entities that did not negotiate the deal. The Salt Lake County auditor's report for tax year 2025 lists four Riverton project areas holding $739,683,813 of assessed value and generating $6,844,913 of full tax increment, of which $2,895,799 was the agency's entitled amount 2. The entity that forgoes most of it is the Jordan School District. On October 2 the State Board of Education's finance committee was told that Jordan's 18 tax-increment project areas paid out $17,277,695 in increment last year and retained $2,151,332 — 89 per cent of the growth paid as increment, against 80 per cent statewide across 282 projects 4. The same presentation closed by asking how much of that additional value would have happened without the agency 4.

Second, the return is flattening as the obligations run on. On May 5, 2026 the council heard that sales tax revenue was about 1.5 per cent ahead of the prior year and that growth had slowed; the discussion recorded that past growth came from rapid population gains and major retail additions, and that future growth is expected to stabilize as surrounding cities build competing commercial space 5. A tool sold as a growth engine is now being defended with a ribbon-cutting count and 1.5 per cent.

Third, the larger half of the district has not been touched. The auditor's report puts the Western Commercial Cmty Dev't Non Collection Area at $362,149,194 of assessed value generating $3,571,008 of full increment, with nothing collected — more value, and more potential increment, than the portion now paying out 2. Two other areas, Redwood Road and 12600 South, hold $9,263,065 and $37,614,412 and produce nothing 2.

That is where the new state law lands. Under S.B. 206, from July 1, 2026 an entity that intends to trigger tax increment must first hold an authorization meeting and, within 30 days, submit a disclosure to the state's program manager 3. The disclosure must state the public good, carry a but-for analysis of each project, and explain how the benefit to nearby residents and taxpayers is proportionate to the benefit to the party receiving the increment 3 — including a present-value estimate of what goes to that party over the collection period or 40 years, whichever is longer, and what each taxing entity can expect over 40 years 3. Triggering increment is what the statute calls the specified event 3. When Riverton triggers the uncollected half of the Western Commercial area, it will have to answer on the record the question this page put on October 16: who bears the cost, and who captures the benefit. By January 1, 2027 the obligation widens to every project area — plan, budget, interlocal agreements and map filed with the program manager, with a progress summary every January 1 after that 3.

Our judgement concerns the decision, not the motive. The Riverton City Council, sitting as the redevelopment agency board, chose the reimbursement structure that sends the increment back out, and it is the body that must now document it. The adopted FY 2026-27 budget shows the shape: $3,100,000 of tax increment revenue against $3,100,250 of CDA project area expenditure, $10,250 for a Redwood Road area that collects nothing, and $10,500 transferred in to cover the difference 1. No notice posted by the agency board since July 1, and none posted by the council through October 20, describes a tax-increment authorization meeting; the board's most recent notices are for June 2 and June 16, 2026 910. That is not yet a violation — the disclosure attaches when increment is triggered and the reporting deadline is still ahead. It is a decision about when to be candid.

Four things would change our mind. File the January package in November rather than at the deadline. Put the uncollected $362 million area into the first but-for analysis, with the 40-year comparison the statute now requires. Publish the sales tax generated inside Mountain View Village, so the return can be set against what the county and the school district forgo. And if the arithmetic shows the increment is paying for development the market would have produced anyway, say so and reduce the participation instead of letting it run.

Sixty-seven days is enough time for all four.
